ESnet Acceptable Use Policy

SCOPE
The
purpose of this document is to convey the acceptable use policy
regarding utilization of the Energy Sciences Network (ESnet).
The policy set forth below defines acceptable practices. This
policy is subordinate to all applicable U.S. government laws,
as well as Department of Energy (DOE) orders.
GENERAL
GUIDELINE
ESnet
is a Wide Area Network (WAN) infrastructure project that supports
the scientific research mission of the Department of Energy,
Office of Science. The ESnet project supports the agency's mission
and strategic goals and objectives by providing DOE with interoperable,
effective, and reliable communications infrastructure and leading-edge
network services in support of the agency's science research
missions. Any restriction of use, contained within this Acceptable
Use Policy, is intended to protect this DOE, Office of Science
resource for its intended use and for which funding is appropriated.
These policies
are designed to assist in protecting the Service, our Users,
and the community as a whole from improper and/or illegal activity.
Users are expected to behave in a reasonable fashion and to
adhere to commonly accepted practices of the internet community.
If Users engage
in conduct while using this service that is in violation of
the Policies or is otherwise illegal or improper, we reserve
the right to suspend and or possibly terminate the user's access
to this service.
The Office of Science
ESnet program is specifically established to support Office of
Science programs. The Office of Science will work with other DOE
programs, as appropriate, to establish Memorandums of Understanding
(MOU) to broaden access to and use of the ESnet by other DOE programs.
This policy also applies to all usage under any such MOUs.
ESnet traffic may
be monitored to ensure that security policies are adhered to
ensure adherence to acceptable use policy.
ACCEPTABLE
Acceptable use
of ESnet includes:

Official communication among DOE, Office of Science funded
principal investigators and their collaborators, regardless
of location.

Approved access to scientific facilities for the purpose of
conducting Office of Science funded and/or approved research
and education.

Any traffic that either originates or terminates within an
ESnet site and that is also compliant with the other rules
and regulations of this Acceptable Use Policy (AUP).

Approved access to and cooperative use of ESnet, as set forth
in MOUs or other agreements / contracts with DOE Office of
Science, for Office of Science information and data resources
between or among other organizations.

Office of Science computational facilities between or among
other organizations.
-
Video conferencing among Office of Science investigators and
their collaborators or facilities for use between or among
other organizations.
-
Communications services between all Office of Science contractors
and their subcontractors for the purpose of conducting business
in direct support of Office of Science programs.
-
General scientific and administrative information communication
concerning any DOE/Office of Science programs and/or other
DOE programs.
-
Communications concerning any professional associations, government/university
committees, and/or individuals associated with the facilitation
of DOE scientific research and education.
-
Application for or administration of Office of Science grants
in support of funded research.
-
Commercial announcement of products or services of use to
the Office of Science community, where the researcher has
specifically requested to be informed of such.

Any traffic originating from a network of another member agency
of the Large Scale Networking Program Component Area with
the following caveats,

The traffic must meet the acceptable use policy of that agency
and the level of network traffic must not interfere with other
stated acceptable use traffic on ESnet.

The destination or source of that traffic must reside on ESnet
where there exists an explicit agreement between ESnet and
the other agency for carrying such traffic.

Any usage conducted under a reciprocal agreement between DOE/Office
of Science and other network providers.
-
Incidental communications among Office of Science researchers
and their colleagues which contribute to their work or facilitate
professional development, currency on issues, or debate in
a work related field of knowledge.
-
Foreign (non-U.S.) traffic, under formal international agreements,
to allow collaboration on projects of international interest.
-
Unacceptable use of ESnet includes:
-
Unsolicited or commercial advertising of for-profit products
or services.
-
Personal use not related to the conduct of work on behalf
of the Office of Science or another organization as set forth
in agreements or contracts with the Office of Science.
-
Lobbying Congress or the Administrative branch for purposes
of supporting or not supporting various issues, programs,
or projects.
-
Use of ESnet to gain unlawful access to computational, information,
or communications devices or resources.
-
Intentional introduction of malicious code, such as computer
worms or viruses.
-
Transmission of material, in violation of applicable copyright
laws or patents.
-
Attempting to intercept, redirect, or otherwise interfere
with communications intended for others
ENFORCEMENT
AND VIOLATIONS
The ESnet Steering
Committee (ESSC), or their appointees, will review alleged violations
of the ESnet Acceptable Use Policy on a case-by-case basis.
Clear violations of the policy which are not promptly remedied
by the offending member organization may result in disciplinary
action. Depending on the nature of the offense, action may also
include referral of a case to appropriate authorities for civil
or criminal prosecution.
MODIFICATIONS
ESnet management,
in coordination with the ESSC, reserves the right to modify
this policy at any time.
